1. General Provisions

1.1 This website is intended solely for consumers who wish to place online orders for Philips water purification series products (hereinafter referred to as the “Products”) and have them delivered by Century Field International, with its registered address at Room 502, 5/F, Nan Wo Hong Building, 148 Wing Lok Street, Sheung Wan, Hong Kong (“Philips Water Hong Kong”), within the Hong Kong Special Administrative Region of the People’s Republic of China.

1.2 By placing an order through the official Philips Water Purification Series online store (the “Website”), you are deemed to have accepted and agreed to be legally bound by the Terms of Use, Sales Terms and Conditions, Privacy Policy Statement, Cookie Statement, and any other terms and conditions published on the Website. If you do not agree to and/or accept any of these terms and conditions, you must not use our online sales services.

1.3 Philips Water Hong Kong reserves the right to amend these terms and conditions at any time without prior notice. However, such amendments will not affect any orders submitted prior to the posting of the amended terms and conditions on the Website.

2. Formation of Contract

2.1 You may log in to or create a personal account on the Website, complete and submit an order. Upon submission of your order, the Website will generate a web order number. Please note that the order number generated by the Website is for reference only and does not constitute acceptance of your order by us.

2.2 Your submission of an order constitutes an offer to purchase the selected Products from us in accordance with these terms and conditions. Philips Water Hong Kong reserves the right to accept or reject your offer and may reduce the quantity of Products we accept for delivery to you. However, your submitted order is binding on you and cannot be cancelled after submission.

2.3 If Philips Water Hong Kong accepts your order, we will send you an order confirmation notification by email to inform you that we have accepted your order. The contract is formed when we send you the order confirmation notification by email.

2.4 Products are subject to availability. If, for any reason, any or all of the Products you ordered are out of stock, or if there is an error in the price, product description, or promotion, we may cancel your order and refund the amount paid for the order.

2.5 This Website provides online sales services only to consumers purchasing as end users. You may not purchase Products on this Website for resale. If we have reasonable grounds to believe that the Products you purchased are not for personal use, we reserve the right to reject or cancel your order.

2.6 Please note that the colours or designs of Products displayed on the Website pages may differ from the actual appearance or dimensions of the Products provided on this Website.

3. Price

3.1 The price of the Products shall be as stated on the Website at the date and time you place your order. All prices are in Hong Kong Dollars. Prices published on the Website do not include delivery charges. Delivery charges will be calculated separately as applicable, displayed on the order, and added to the total order amount.

3.2 You may pay for your Products using the payment methods displayed on the Website’s payment page. By confirming payment through the Website, you are deemed to agree to the terms and agreements (if any) of the payment service provider designated by the Website.

3.3 The prices of our goods may change from time to time, but price changes will not affect any orders that we have already accepted by sending an order confirmation notification.

3.4 A large number of goods are listed on our Website. Despite our reasonable efforts, it is always possible that some of the goods on our Website may be incorrectly priced. If we discover a pricing error, we will notify you and allow you to choose to proceed with the purchase at the correct price or cancel the order. We will not process your order until we receive your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and you could reasonably have recognised it as a mispricing, we are not obliged to provide the goods to you at the incorrect (lower) price.

4. Delivery of Products

4.1 Philips Water Hong Kong will deliver only to the contact information and delivery address registered by you in the order. You may select direct delivery by the merchant, but due to delivery area restrictions, Philips Water Hong Kong may adjust your selected delivery method without further notice.

4.1.1 If we deliver the Products to you by direct merchant delivery, the logistics company we engage will contact you within 4 working days after your order is confirmed to schedule delivery arrangements. Direct merchant delivery service hours are from 9:00 a.m. to 6:00 p.m., Monday to Saturday, excluding Sundays and public holidays.

4.2 The logistics company may contact you by telephone or SMS to confirm delivery arrangements. Please ensure that you enter a valid mobile number in the order. If your ordered Products are to be delivered to different addresses, you must submit separate orders for each delivery address.

4.3 Delivery services are limited to fixed addresses within the Hong Kong Special Administrative Region that are accessible by road transport, covering Hong Kong Island, Kowloon, the New Territories, Tung Chung, Sai Kung, Discovery Bay, and Ma Wan. Delivery services do not apply to non-fixed addresses, airport restricted areas, border restricted areas, outlying islands, hotel restricted areas, logistics warehouses, consolidation warehouses, locations requiring security passes/clearance, and/or post office box addresses.

4.4 Delivery charges (if applicable) shall be paid by you in accordance with the instructions on the invoice, depending on the delivery area and the logistics company’s quotation. If the total value of a single order is less than HK$1,500, a delivery fee of HK$85 per order will apply. If the total value of a single order is HK$1,500 or more, the delivery fee will be waived.

4.5 Additional delivery fees will be charged per order in the following circumstances:

4.5.1 If the Product cannot be transported via elevator at the delivery address or there is no elevator available, the logistics company’s delivery personnel will collect an additional cash fee of HK$20 per floor (calculated per 15 steps as one floor);

4.5.2 For delivery to remote areas, additional delivery fees will be charged as follows:

  • Mid-levels or above on Hong Kong Island, Shek O, Stanley, Tai Tam, Deep Water Bay, Repulse Bay, and Sai Kung: HK$150
  • Lok Ma Chau, Sha Tau Kok, Ping Che, and Ma Wan: HK$150
  • Lantau Island and Tung Chung: HK$180
  • Airport and Discovery Bay: HK$250

4.6 If the Product cannot be delivered due to reasons attributable to the recipient (including but not limited to incorrect delivery address, delivery address being a post office box, failure due to security personnel obstruction, recipient refusing to sign for the ordered Product, etc.) and must be returned to Philips Water Hong Kong, Philips Water Hong Kong may reschedule delivery of the returned Product, but a re-delivery and administrative fee of HK$200 will be charged each time, and any previously collected delivery fees (if any) will not be refunded. If delivery cannot be completed within 30 days after the initial dispatch due to reasons attributable to the recipient, the Product shall be deemed abandoned by you and no refund will be provided.

4.7 Any delivery or dispatch dates provided by Philips Water Hong Kong are best estimates only, and Philips Water Hong Kong shall not be liable for any loss, damage, costs, or expenses caused by failure to deliver on the delivery or dispatch dates displayed on the Website. Out-of-stock items may delay delivery of the entire order.

4.8 When Typhoon Signal No. 8 is hoisted or a Black Rainstorm Warning is in effect, delivery services will be temporarily suspended. In such cases, delivery of the ordered Products will be rescheduled.

4.9 To protect customer rights, you may be required to present the invoice upon delivery and/or collection. If the customer fails to present the relevant documents, we reserve the right to refuse delivery and/or release of the goods.

4.10 Once the goods are delivered to the address specified by you in the order, delivery of the Products shall be deemed complete. Ownership of all Products and the risk of loss or damage shall pass to you upon delivery to the address specified by the customer, and we shall no longer bear any responsibility for them.

5. Exchanges, Returns and Refunds

5.1 In general, we do not accept any requests for product exchanges or order cancellations. Philips Water Hong Kong will only process exchanges or refunds for ordered Products within 7 days after delivery completion, subject to the following conditions:

5.1.1 You provide evidence proving that the Product was defective prior to delivery and that the defect was not caused by human damage;

5.1.2 The Product does not match the model or quantity specified in the order.

5.2 Upon receipt of the goods, you must immediately inspect the ordered items to ensure they match the Products you ordered, are free from damage, and include all accessories. Unless you notify Philips Water Hong Kong of any issues with the ordered Product via telephone and/or email within seven (7) days after delivery completion, the Product shall be deemed to have been correctly delivered and accepted by you as being in good condition.

5.3 Philips Water Hong Kong shall, at its sole discretion, determine whether the Product meets the conditions for exchange or refund. You shall be entitled to an exchange or refund only if the following requirements are satisfied; otherwise, we reserve the right to refuse any exchange or refund:

5.3.1 Upon review of the information provided by you, it is confirmed that the Product was defective prior to delivery completion and that the defect was not caused by human damage;

5.3.2 The returned Product must be accompanied by its original packaging, all accessories, and any printed materials inside the packaging box, all in good condition;

5.3.3 The returned Product must not be damaged, scratched, stained, or show any traces of water damage, unless such damage, scratches, stains, or water traces existed prior to delivery completion;

5.3.4 The returned Product must not have been registered for online warranty service or undergone any repairs;

5.3.5 You must present the original proof of purchase and delivery note for verification.

5.4 If, after our inspection and/or verification, the Product is found to be defective, we shall, at our sole discretion, repair and/or replace the Product. If we agree to replace the Product but the requested replacement item is out of stock, we will refund the relevant amount to you.

5.5 The Product must be returned together with all promotional gifts included with the purchase; otherwise, we will deduct the value of such gifts from the refund.

5.6 Once we have reviewed and approved your refund request, the corresponding amount will be refunded to the account or credit card used for payment. The refund process typically takes approximately 2-4 weeks. We will not refund any delivery fees.

6. Warranty

6.1 The terms and conditions of the Product warranty can be found at https://www.philips.com.hk/c-w/support-home/warranty.html.

6.2 Unless otherwise specified, no warranty is provided for spare parts, accessories, and/or consumables of Philips-branded household appliances sold on this Website.

7. Liability of Philips Water Hong Kong

7.1 These terms and conditions set out our entire obligations and liabilities in respect of the supply of Products (and the provision of customer service and warranty services) and any services provided.

7.2 Except as otherwise provided in these terms and conditions, Philips Water Hong Kong shall not be bound by any other warranties, conditions, or terms relating to the supply of Products or services.

7.3 To the extent permitted by applicable law, any other warranties, conditions, or terms that may be implied or incorporated into the contract by statute, common law, applicable laws in the jurisdiction where you purchased the Product or service, or otherwise (including but not limited to any implied terms as to quality, fitness for purpose, reasonable care, and skill) are hereby expressly excluded to the maximum extent permitted by law. In particular, Philips Water Hong Kong shall not be responsible for ensuring that the Products are suitable for your intended use.

7.4 Philips Water Hong Kong shall not be liable for any indirect or consequential loss or damage arising out of or in connection with the supply of Products and/or services, including but not limited to loss of income, profits, contracts, or data, whether arising from tort (including negligence), breach of contract, or otherwise. The total aggregate liability of Philips Water Hong Kong under these terms and conditions and our contract with you shall in no event exceed the amount paid by you to Philips Water Hong Kong.

7.5 Nothing in this agreement affects your statutory rights as a consumer.

8. Data Protection

8.1 If you are a registered user, you may log in to your account to view your order history, allowing you to check your order status and details.

8.2 By placing an order, you agree and understand that Philips Water Hong Kong may store, process, and use the data collected from your order to process your order. Such data will be handled in accordance with Philips Water Hong Kong’s Privacy Policy, which you can view by clicking the “Privacy Policy” button on this Website. If you wish to access the information we hold about you, make any changes, or opt out of receiving information from Philips Water Hong Kong, please follow the procedures set out in the Philips Privacy Policy.

9. Events Beyond Philips Water Hong Kong’s Reasonable Control

9.1 Philips Water Hong Kong will make every effort to perform its obligations under the contract. However, Philips Water Hong Kong shall not be liable for any delay in performance or failure to perform its obligations if such delay or failure results from events beyond our reasonable control. In the event of delay, Philips Water Hong Kong will perform its obligations as soon as possible.

10. Governing Law and Dispute Resolution

10.1 These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

10.2 The parties agree to submit to the exclusive jurisdiction of the courts at the place of registration of Philips Water Hong Kong for any disputes relating to these terms and conditions.

11. General Provisions

11.1 Failure by Philips Water Hong Kong or you to enforce any provision of the contract shall not constitute a waiver of that provision. Such failure shall not affect the right of either party to subsequently enforce that provision.

11.2 The invalidity or unenforceability of any provision of the contract shall not adversely affect the validity or enforceability of the remaining provisions.

11.3 In the event of any discrepancy between the Chinese and English versions of these Sales Terms and Conditions, the English version shall prevail.
